E-Courts to Promote Transparency of Information to the Litigants
| Original Article
The present paper proposes to make a modest attempt to analyse the persistent problem of speedy justice and transparency of information to the litigants in the Judicial System in the light of e-courts Mission Mode Project under the National e-Governance Plan. In the age of digitalization, the transparency, accessibility and effectiveness of the justice delivery system is the need of the hour and is easy to ensure at the click of a mouse. This would aid in ensuring the fundamental right of speedy justice under Article 21 of the Constitution of India. Emphasizing upon the belatedness of our justice system, Justice Krishna Iyer made a remark in a case, “Our justice system even in grave cases, suffers from slow motion syndrome which is lethal to ‘fair trial’ whatever the ultimate decision.”Faced with limited resources and manpower, the judiciary is facing many hurdles in terms of service delivery mechanisms, which fails to ensure the access to court and the smooth court proceedings resulting in delayed justice. If technology has its way, soon enough the tardy judicial process of trials can take place smoothly and tackle the risks involved therein.
